Criminal Cases

Our walk-in hours are 8:30 AM to 4:30 PM Monday thru Friday excluding State Holidays. We will accept telephone calls between the hours of 9:00 AM and 3:30 PM. Although Criminal records are open to the public, no information is given without a case number. We are not authorized to give legal advice.
The Criminal Department does not perform criminal record checks. For record check inquiries, please call Maryland State Headquarters at 1-888-795-0011.

The Criminal Department of the Anne Arundel County Circuit Court Clerk's Office handles a variety of criminal cases. All felony charges are heard in the Circuit Court with the exception of some felony theft charges that may be heard in the District Court. Lesser offenses which would normally be heard by District Court may be heard by way of a jury demand in the Circuit Court. In addition an appeal of a District Court sentence, indictment or information may be heard at the Circuit Court.
After a defendant has been found guilty, either by a judge or a jury, he/she may file for an appeal to the Court of Special Appeals. A defendant, if qualified, may apply for an expungement of his/her record.
The Circuit Court Criminal Division performs many duties which include filing and docketing case pleadings, issuing summonses, subpoenas, warrants, body attachments, and writs. Bonds are issued upon order of court to secure defendant's presence at court hearings.
All files and information pertaining to criminal cases are public record and can be accessed in person at the Criminal Office. Cases that have been sealed cannot be accessed without an order from a judge.
CRIMINAL FEES
Charging Documents (Reference Rule 4-201)
Charging documents are filed in the Criminal Department on an indictment or an information by the State’s Attorney Office or on a charging document filed in the District Court for an offense within its jurisdiction if the defendant is entitled to and demands a jury trial or appeals from the judgment of the District Court.
Initial Appearance of Defendant (Reference Rule 4-213)
The Circuit Court Criminal Department will docket the Criminal case and issue a case number. The clerk shall set a hearing date for an initial appearance and issue a summons with a copy of the charging document attached. The summons advises the defendant to appear in person at the time and place specified in the Circuit Court or have enter an appearance in writing at or before the time.
Bail Bonds (Reference Rule 4-217)
Bail bonds, (written obligation of a defendant, with or without a surety or collateral security, conditioned on the appearance of the defendant as required and providing for the payment of a penalty sum according to its terms) may be posted in the Criminal Department during operational hours –8:30 AM TO 4:30 PM. Petitions for forfeiture of bond filing fees: extension of time $25.00, remission $25.00 strike $25.00.
Subpoenas for Hearing or Trial (Reference Rule 4-265)
The Criminal clerk shall prepare and issue a subpoena commanding a witness to appear to testify at a hearing or trial on request of either party. Requests must be filed at least nine days before trial – not including the day of trial and intervening Saturdays, Sundays, and Holidays. Request shall state name, address and county of the witness to be served also the date, time and party requesting the subpoena.
Motions (Reference Rule 4-252)
A motion filed pursuant to this rule shall be in writing unless the court otherwise directs, shall state the grounds upon which it is made, and shall set forth the relief sought. No paper may be electronically transmitted to the court for filing. (Rule 1-322(A). However, a facsimile copy of a paper may be submitted and accepted for filing. (Rule 1-322(b) Parties submitting motions or other papers for filing in more than one case should submit sufficient copies to accommodate the filing and docketing of the motion or paper in each file referenced in the caption.
Expungement of Records (Reference Rule 4-501 through 4-512)
Petitions and General Waivers (attachments) are filed and processed in the Criminal Department. The filing fee for expungement of records is $30.00 and is non-refundable. The petition will be processed upon payment of costs. Please make check or Money order payable to the Clerk of the Circuit Court for Anne Arundel County.

Appeals (Reference Rule 8-201 and 8-202)
Except as otherwise provided in this rule or by law, the notice of appeal shall be filed within 30 days after entry of the judgment or order from which the appeal is taken.
At the time of filing a notice of appeal (within the time for transmitting the record under rule 8-412 in a criminal case) an appellant shall deposit the fee prescribed. The filing fee for appeals is $110.00 -2 checks made payable to the Clerk of the Circuit Court for Anne Arundel County (1) $60.00 is for Circuit Court Filing Fee (2) $50.00 Appeals Court Filing Fee.
